Can I settle after Bankruptcy?

    I have a bad check on my credit report for 26.00. It was discharged from Bankruptcy. Should I send a letter to settle and I will pay if the CA takes off my credit report? I didn't know if I could do this.

    I dont' think you should mess with it. Just dispute it with the CRA.

    Hi Wondergirl,

    If the debt was included in your BK you don't owe it.

    Would it help my credit report if I have it taken off? I would like to get some of these collection accounts taken off.

    If it was discharged in BK it shouldn't be showing you owe anything on your CR's.

    I'd not contact them to settle, there is nothing to settle.

    Nodding with Breeze, dispute it with the CRA's.

    Dispute it, but don't pay it. I remember hearing that going back and paying a debt that was included in BK will void the BK completely, which puts you back to square one. Anyone?

    No, your BK can't be voided after discharge by paying a debt. Very few things can pop up that would cause that drastic action, something along the lines of fraud.
    I do agree with everyone else though....don't pay it, dispute it and hope for the best. Remember you are already protected from anyone coming after you over this debt so you really have the upper hand. Even if you don't get it removed by disputing it, you still don't owe it. I still have several trade lines that show a balance instead of included in bankruptcy and as tempting as it is to get them "included in bankruptcy" so that my score will go up a little,...I don't do it because I know in the long run if I get them removed completely I will be better off.... one of them I disputed has already come back as verified but I will just try again in 90 days until it's gone or I am :) it isn't the easy and the waiting sucks, but....

    skwirl, why don't you dispute your info as inaccurate so they will eithre delete or say included in bk? your not telling them its in bk therefore not incriminating youself? just curious

    Thanks!!!!!!!! A million!!!!!!!! I'm so new to this I guess I never thought of it. Should I wait now 90 days to dispute it again or go ahead and try now? You are an absolute genius! Thanks again :)

    wait 90 days? are you in dispute now? i personally dispute again as soon as i recieve an updatetd credit report, it has worked for me so far i have gotten 95% of my stuff removed. others may not agree w/me though

    on several things with all three CRAs. The one thing I wanted off is the only one verified so far. Waiting on a response to the rest.

    Athough your BK may not be void, it is actually *illegal* to pay ANY debt that was discharged in BK w/o a reaffirmation agreement.

    Do not pay this. Dispute it.

    its not illegal to pay a debt that is not reaffirmed, it IS illegal to attempt to collect a debt that was discharged.

    You may voluntarily pay any debt you wish that was discharged, that is how I am keeping my trailor that I didn't reaffirm..I simply continue to make payments.
