Can I sue an original creditor?

    As I've said in a post a few weeks back, I sent a validation letter to an original creditor, asking for anything bearing my signature to prove I ever had an account with them. I threatened the legal action, etc. To my surprise they apologized and deleted my account from all cra's. Of course, I've now sent the same letter to a couple of other original creditors to see what happens.

    Question:

    Can I really sue the original creditor for anything in small claims court? My accounts are around $1,000. Would they bother to even show up? Would I sue on the grounds of "Account isn't mine." (to the best of my knowledge) ? It seems strange if it only works with collection agencies. It also seems strange that my orginal creditor got scared by my letter and deleted everything!

    If they are reporting false info to CRA's then they are in violation of FCRA.

    If they were in error when they billed you, you could have invoked your rights under FCBA.

    Anybody can sue any body. That's why we live in a sue happy sueciety.
