I have been having trouble with BankOne for a while now. Supposedly I opened a savings account with them in May of 1998. Then supposedly the savings account which had no overdraft was overdrawn by $800 dollars. I went to open a new checking account a year ago and they denied me because BankOne reported this Savings account to Chexsystems. I wrote Chexsystems and said it was not mine. They verified it. After finding this board about a year later, last month I wrote them a letter saying to verify it and show me my signature. They just sent me a letter back that says SIGNATURE CARD-PERSONAL at the top. He has my SS# typed on it and all my info typed on it. Then it has a place for signature and the date next to the signature. Someone just wrote my name in print in the area where it says signature. They did not put a date in the date box. This is clearly not my signature and I can prove it. I have never signed my name this way. It is bubble letter print like a young girl writes. Not even close to my signature. They totaly put down a fake signature and sent it to Chexsystems. Can I sue them for this. Should I send them or chexsystems or both a Intent to File Suit. Where do I find a sample letter of that.

I had a gas company pull that on me one time concerning a refund on a security deposit. When I asked for the return of my deposit they said they had sent me a check for it. I asked them for a copy of the check. When I got it the front of the check was Made out to me all rite but they had forged my name on the back for the endorsement. I never saw the original check at any time because the gas company made the check out to me forged my name on the back took the check to a bank and cashed it to make it appear like they had refunded my deposit. Step 1: Find applicable FCRA and FDCPA statutes Step 2: Find damages (actual, out of pocket) or incidental (caused by not having the checking account) Step 3: If damages and statute violations are more than your local Pro Se court allows, hire attorney; else file small claims court Go from there. I'd love to see StankOne grovel their way out of a forgery.
I would write back informing them that you received a signature card and that you are still waiting for YOUR signature card.....not a forged copy but the real thing. You don't need any special letter just write from the hip and tell them that is NOT your signature and someone better get to bottom of this ASAP
