Can I sue for non PP

    My wife signed up for the OPT-OUT list and several months have past (more than 90 days). She just got another of the terrible sub prime offers (one of the few companies that she keeps seeing on her Credit Report with inquiries)

    If we get a copy of her credit report, and it shows a recent inquiry, do we have a slam dunk non PP case, and if so should I write up an ITS and send it to them?

    If there's a good case against them, then I think it would be worth it to get a fresh copy of her credit reports.

    I think your beef is with the CRA, not the CC company:

    § 604

    (e) Election of consumer to be excluded from lists.

    (1) In general. A consumer may elect to have the consumer's name and address excluded from any list provided by a consumer reporting agency under subsection (c)(1)(B) in connection with a credit or insurance transaction that is not initiated by the consumer, by notifying the agency in accordance with paragraph (2) that the consumer does not consent to any use of a consumer report relating to the consumer in connection with any credit or insurance transaction that is not initiated by the consumer.
