Can I sue GC Services???? re AMEX

    Hubby had an American express Skymiles card (revolving) which went into collections. We were contacted by GC Services demanding payment in full of the entire $4600 balance. We made an initial payment of $2000 by Western Union. A few days later, the rep called back to demand the remainder of the balance. He suggested we do a wire transfer, which would be less expensive than Western Union, and he gave us their account and routing number. Hubby made a second payment via bank wire transfer of $2600, and faxed the receipt to GC services at the number given to us. Meanwhile, hubby was contacted by a “supervisor” who demanded payment and expressed outrage that we wired it (as though we had somehow stolen their account and routing number??). Anyway, we paid the entire balance within 10 days of the account being transferred to the CA. Yesterday the original rep calls again to tell me he has no record of the wire transfer, despite that fact that we faxed the receipt and have the transmission report showing it went through. He demanded payment of $2600. My hubby again faxed the receipt, the transmission report from last week, and a note informing them that this represents payment in full and to leave us alone. We will of course follow up with a CRRR copy of the western union and wire transfer receipt.

    Is GC Services out of line for continuing to contact us regarding this debt? I’d like to write threatening letters to Amex and GC Services, but I’m not sure whether I have any basis. What I’d like to try is a nutcase variation that threatens suit if any adverse information is placed on hubby’s report as a result of their failure to properly reflect payment in full. This information is NOT currently reflected on his report – Amex isn’t even showing late, and I’d like to keep it that way. Can’t Amex be held responsible for the actions of the CA?

    I don't believe GC Services reports. They held an account of my DHs and it never showed on his reports, before or after he paid. But I know that he had to fight for a letter that he paid in full with a Cashiers Check.

    Ok- that's good to know...I was getting calls from them this past spring and nothing ever showed up on my report either. Thanks!!

    • Ignore them. You have paid off the account, you have proof of that, therefore - there is no debt, therefore - from that point you have nothing to do with them anymore.

      If they call you again, send them the following C&D letter:

      «Your Name»
      «Address1»
      «Address2»
      «City», «State» «Zip»

      «Company»
      «Address1»
      «Address2»
      «City», «State» «Zip»

      «Date»

      RE: Account #_________/Original Creditorâ??s Name

      Dear Sir/Madame:

      This will serve as your legal notice under federal law, "The Fair Debt Collection Practices Act," to cease ALL communication with me in reference to the above account. If you fail to heed this notice, I will file a formal complaint against you with the Federal Trade Commission responsible for enforcement, the state Attorney Generalâ??s Office, as well as the American Collectorâ??s Association which monitors for noncompliance.

      Should any adverse items be placed on my credit report as a result of this notice I will be forced to seek legal action against you and your client.
