Ok, I want to know the order in which I should proceed to set these people up for a suit. Situation: I graduated college in 2001, and the school billed me for unpaid parking tickets ($170), and reported them to CRAs as a "Student Loan" 60/90 days late. I wrote them to request they remove the listing, but they refused and pulled an non-PP inquiry (i assume to check the wording of the credit report for themselves.) I disputed the balance with Equifax (it showed I still owed the money, when I'd already paid it). Now I want to know what I should do? 1. Should I again dispute with the CRAs as "not mine" since the description--student loan--is incorrect? 2. Should I write another Goodwill letter to the college, or is it better to dispute with the CRA first? 2. Do I need to wait until the CRA's validate before I sue the college (original creditor)? 3. Should I just forget about validation and sue for $1000 for the non-PP inquiry? Also... I have 1 30 day late for Discover and FirstUSA, both from 2000. Can Discover or FirstUSA check their records back that far?
You've already admitted that the debt is yours, so disputing is as "not yours" is a waste of time. You told them it was yours. You need to inform that school (via CRRR mail) that they're reporting it incorrectly. If they don't fix it, you then have reason to sue them. I'm going to go out on a limb here and say that Discover and First USA probably keeps records dating all the way back to the last century....maybe even further.
