Here's my situation. Was denied a mortgage for new home construction recently. Checked my EQFX credit report and found that two items are absolutely, undeniably wrong. An old Sears tradeline (closed) that should have aged off of my account last year was reported with a new Last Activity date of 12/03, adding another seven years to the tradeline. Also, an old (closed) Direct Merchants credit card account was listed with an outstanding balance of over $2,100, but that account was a secured card. I want to know if I can successfully sue EQFX for reporting these errors. Or can I only sue the creditors who incorrectly reported the information to EQFX? And now that the damage has been done (denied mortgage) can I sue the CRA even without disputing the information with the CRA (I don't want to give them a chance to change it)? Is there any chance that I can get EQFX to delete all of my negative tradelines as a settlement for their violation of the FCRA? Thanks. BurnaDebt
Did you dispute these two tradelines before being denied? I don't think you've got a prayer of success in court unless you've given the CRA a chance to fix the error.
