Here is the situation. I filed bankruptcy, chapter 7 in april of 03, with the discharge in oct 03. A garbage company, Washington Hauling, had me down for $35.22, and they were notified of the BK and that they were in it. After the discharge, they sold off the account to D&B (dunn and bradstreet recievables) who writes me at least once a week, sometimes more. I called them in Dec. and told them of the bankruptcy. I gave them the information. Now the collection letters keep coming, but now they have my attorneys name on them too. I sent them a cease and desist, reminding them of the fact that this was discharged in bankruptcy, by certified mail, and I got the green card back. This was 2 weeks ago. Today, and all on the same day mind you, I got not 1, not 2 but 3 collection letters from them, all clearly written after they signed the green card, and postmarked a few days afterward! Can I sue these people fro stress or harassment or violations of something? This is now bordering on ridicolous. It is almost like they are enjoying doing this... can someone offer suggestions??
you should let your BK lawyer know about this. I believe they can be held in contempt before the bankruptcy court for continuing collection efforts on an account IIB
