A girl at work is five payments behind on a credit card. She said she is cashing out her IRA to pay off some debt. Anyway, this guy called our work today (small office, just us two and our boss) and our boss answered the phone, he asked for her and was told she was on another line but he could hold. This guy starts to tell our boss that he has a payment plan he wants to talk to her about. She was so upset. She picked up the line and told him she was not allowed calls at work and not to call back, then she hung up. He called back again and I answered, he told me that if she would give him 5 seconds he wouldnt bother her again. She again picked up the phone and told him not to call her at work. I felt sorry for her, it was so obviously a bill collector. I was shocked he told our boss that he had payment options for her. He called her last week and she told him not to call, yet here he is calling her again. Anyway, I am not sure what she can do. Im sure its illegal but I mostly used the FCRA or FDCPA when repairing my credit. What laws apply to original creditor? She said its not a collection agency but she should still be able to do something. Any advice would be appreciated. Thanks

CREDITORS can call you at work, at home, at the bowling alley etc. They are not covered under the federal statutes. BUT, your state's consumer protection laws might apply. "a payment plan" does not really constitute a clear violation of "3rd party disclosure"
