I have an account that is listed with the orgianal creditor, It is listed twice two different dates of last activity, but the first one is listed as a charge off, and the second time they have it listed as a collection account. I just checked my report today and they have now the same account with the same account number listed as a charge off twice. My question is can they do this, they are really charging the account twice.
Can they do it? Well if it is from the same Company they CAN NOT its a duplicate account. If it is same account from the OC and a CA "i'm pretty sure" it is OK for them to post it. That right there is enough to fix their little red wagon for them. Thats the really illegal thing you should go after. One collection agency in California got hit with a $2 million dollar fine for doing just that. If you could get even a quarter of that amount for damages you and the lawyer you got to file the case for you would both be well off. Thats what I would do. Go hunt a lawyer willing to take the case on a fee contingency basis.
