I am in the process of settling an account with citibank for 952.00. when I talked to the paralegal who is in charge of my account she told me that I have to have the money in by 8/5 to stop further court proceedings. Last week I got a confirmation letter stating the settlement amount and our agreement the only thing is that they changed the date to 7/30/04. That isn't fair in my opinion b/c on the phone the paralegal told me that I had to have the money in by8/5 so I made arrangements to have all the money together by that date. What can I do?
This is why you need to get EVERYTHING IN WRITING! Don't deal with any CA by telephone!!! Tell them that according to your contemporaneous notes made during a phone conversation with so and so on such and such date, you made a VERBAL AGREEMENT to pay by 8/5/04
well now she won't return my calls. It is actually an attorneys office. They are taking me to court for a breach in contract for payment arrangements made in 2001. I defaultted on payments after moving on my own and they are trying to get a judgement. I agreed to a asettlement to salvage my credit report. I already have one judgement and do not want another one.
if they won't take your calls then put it in writing and send it to them CMRR. If you don't want another judgment then you need to appear in court. Hopefully the judge will allow a pre-trial conference with them to see if you can work out a new payment agreement and avoid trial
on the affidavit, they said on there that it wouldnt' go to trial and that the hearing would only take approx. 3 hours. They want an order for a judgement. I will send a letter certified mail return receipt. but at this time I don't see any way out of this but to pay them the money. Even if I go to court I don't have an attorney and i'll most likely lose.
