i am in the process of trying to remove old addresses from my credit report and experian keeps sending me responses telling me that the address will remain because it was provided to them by my creditors. i have sent them letters requesting an account of who reported these addresses and when and they keep sending me the same response. is this legal?
they should update your information. I would recommend calling a lawyer about it as well. Hey does Any one out there know about Trans Union? My wife got her free credit report and TU actually reported all of the information correctly The names of the the creditors as well as the full account numbers. Can they do this?
can they do this if the cra refuses to delete my old addresses, don't they have to provide supporting documentation of how they know these addresses are accurate?
Are they reporting your old addresses as old addresses, or as current addresses? If those old addresses are, say, still the address of a parent or relative, are CC offers in your name still being sent there?
If they were in fact your old addresses, there is nothing improper about them showing on your credit reports as old addresses. In fact, when you order your reports on line, verifying old addresses is often how they verify that you are who you claim to be. Why do you want to remove them?
well because in reading, i read the steps to repairing your credit were to get the old info deleted. just a newbie trying to follow instructions..was this bad advice?
Not bad advice, just no guarantee you can do it. Since they don't have to remove accurate information, it doesn't leave you with many options if they don't. On the other hand, if you have accounts showing that are not yours, along with addresses that are also not yours, dispute both. CRAs merge identities by multiple partial matches. If your names are similar, if one CA gets an erroneous account and wrong address in your files, it makes it easier for another CA to also put other erroneous accounts associated with that address in your files. You can start collecting some other person's bad accounts.
I think that CRA's can probably get by with leaving old addresses in place, however, the way in which Experian implies that they will not re-investigate them upon dispute is a violation of the FCRA. With that said, it would be virtually impossible to prevail on such a claim insofar as establishing damages would be extremely difficult.
If erroneous accounts are resulting in erroneous addresses, then getting the erroneous accounts removed should make it possible to get the erroneous addresses removed. That would apply more to either misidentification, or id theft, where there are specific FACTA requirements for CRAs to remove ALL information resulting from the id theft.
