I had my car loan with a credit Union. I paid the car loan off after 48 months in March, with 2- 30 day lates. I filled BK about 6-weeks later. I got a copy of my credit reports and Credit Union pulled a report even after everything was paid off with them. Can they do this? Thanks
Your business relationship ended with them when the account was paid off. No business relationship or application for credit=no permissible purpose.
Should I ask the Credit Union to take off my late pays since they had no permissible purpose to pull a credit report? What kind of letter could I send?
You may have given your credit union the ability to pull reports when you opened your checking account. If you have a checking account with them, they most likely have a permissible purpose or an explicit purpose to pull your report. Check out your account agreement. Most CU's are friendly. Why not just call them, talk to the credit department and ask why they pulled a report? If you are nice, they may both remove the late pays and the inquiry.
Thanks! I have a savings account not a checking account. Can they still pull the credit report for only a savings account?
What's your contract with them say? What permissible purpose (found under "Permissible purposes") in the FCRA could they have to access your file?
