Can they pull a hard for goodwill?

    I had several loans with a credit union. The loans hae been paid off over 1 year ago. I mailed off a goodwill letter last week. I wanted to try to get 2 30 day lates off. I checked my credit report early today ans saw that the credit union pulled a hard inqury on my Experian report. Can they do this? I no longer have any loans, or accounts with them.

    Technically, they do not have permissible purpose for the inquiry after the account is closed. However...

    What's more harmful to your score? The two 30 day lates or the one inquiry? Choose your battles carefully. I'd not quibble with the inquiry but I'd continue to pursue a request to have the lates deleted.

    You are NOT applying for a CREDIT CARD or LOAN...NO PP

    They probably had NO IDEA what they are reporting...SO THEY PULLED A "HARD"...for some reason they DON'T know about "SOFT"

    If they dont remove the lates then I might have to go after the hard inqury. This is the second time they have pulled a hard inqury since the loans have been paid off.

    You could write a well thought out letter to them, informing them of their violation by dinging a hard inquiry with no permissible purpose. I'm sure if they understand that they broke the rules and could be held liable for $1,000 that they would probably be willing to request the removal of the hard inquiry because it was made in error, and then remove the lates and update the tradeline to a good tradeline. Remember you can catch more flies with honey than with vinegar, and if you start to sue them you can forget about EVER having the lates removed.

    Does anybody have the section of the FCRA or FDCPA concerning permissible purpose to quote in the letter?

    Just a thought.
