Just had a thought this morning... Since both EX and EQ supply consumers with incomplete credit reports by masking the last four digits of account numbers, and the FCRA mandates that credit reports must be "complete and accurate"; can their unwillingness to supply these masked numbers (by a consumer's written request) be construed as a violation of the FCRA?
Brainstorming is great. Although your argument would appear to have validity on the surface it would be counter balanced by their insistence that they mask those numbers for security reasons, in case it fell into the wrong hands. With all the ID theft going on, they'd carry the day. Nice try.
Yes, Butch, I agree with you to some degree, but now consider this scenario: What if the masked numbers in question were for an account that the CRA now refused to investigate on the grounds that it was "previously verified"? How could they reasonably argue that: 1) they investigated an account and will refuse all future investigations of that account on the grounds that the information is accurate, yet, 2) also refuse to supply the consumer the same "accurate" account information they used to verify the account? Also, what if the consumer request for the complete account information was sent crrr, on a notarized letter? It would be pretty difficult for them to claim that they doubted the identity/authenticity of the sender for security reasons, wouldn't it?
Your right ID theft is horrible, but why is it when you have to or want to dispute something in writing they want your SSN and DOB sent through the US Mail with the heading Experian Equifax.. BIG ALERT FOR ANY DECEPTIVE POSTAL WORKERS.. That is a prime way for people to really cause havok with your credit by opening new accounts not using ones you already have.. A thief having a account number with no SSN is pretty useless.. It is hardly likely, they can call get your info without having your SSN and then even if they were to get teh balance info and so forth.. They would never be able to have a dup card sent to a new mailing addy. So I guess their counter balanced arguement is merely a way of ducking out of the question at hand.. Why isnt the numbers given..?? Cause ID security isnt the reason at all..
Re: Re: Can this be used as a violation? Good point. I never thought of that. Also, a great rebuttel for if or when I have to go to court. So here are my violations (I hope): 1) The failure to supply a procedural request. 2) The failure to supply complete and accurate information (e.g. the masked account number). 3) Failure to delete an account that could not be verified by the alleged OC. Hopefully, it works.
