Can wages be garnished in GA?more

    Before I start validating with my creditors I would like to make sure that they can't come after me and collect with a garnishment.

    GARNISHMENT

    Garnishment is a court-ordered collection method available to creditors. Once the creditor files the garnishment papers, an employee can challenge the validity of the garnishment and the amount. Employers can also challenge the garnishment but they must file an answer within 45 days of the date of the garnishment notice. If an employer fails to file the required answer, the creditor can seek a judgment against the employer for the full amount of the employeeâ??s debt. An employer may not discharge an employee on the basis that the creditor is garnishing the employeeâ??s wages.

    So Georgia does have garnishment. Two other things you should consider are the SOL term (is it up?) and the debt amounts (is it enough that any one creditor will think it's worth it to sue you?).

    When does the statute of limitations term start? Also, which state do you use? The one where the debt was originated, the one you live in now? What do they have to do prior to garnishment? Do they have to obtain a judgement or file something?

    basically they get a judgement in court, then if they know where you work they can process a garnishment.

    If you plan to ditch a bunch of debt, good idea to switcheroo jobs. The only debtor that will find you then will be the IRS :)

    they have to notify me when they file to obtain the judgement, right?Switching jobs is not an option. This debt is a deficiency balance from a voluntary relinquishment of a vehicle during a ch. 13 which was dismissed. we paid everyone off but them and the original creditor gave it to a company called RA Rogers. we have been paying them 100 a month for about a year now but are nervous because we moved and they now want our new address. They called my husband at work. any advice?
