Ohh boy, I'm already tired of this and just don't know what else to do. I mailed them "goodwill adjustment" letter over 2 months ago - NO RESPONSE Sent them fax almost 2 weeks ago - NO RESPONSE They keep verifying on EX and TU and I'm still waiting for EQ. I called EX and TU and asked them to send me procedure informations and the said they would. Yesterday, I received a letter from EX stating the item was updated and verified and it states now: Your comment: "Account information disputed by consumer (Meets requirement of the Fair Credit Reportin Act)" That came back about a week after I called. It doesn't seem to me that they really verified it. WHAT SHOULD I DO? Please help me, Thanks PS. Pat had an idea of sending a letter to the creditor stating that the info they post are different on different reports and thus they are reporting an incorrect info and they should delete it or be sued. Just checked my report again and EACH of them report something different. PAT or anybody, is that they way or getting rid of this stuff or maybe there is something else I could do. If I can't, I'll just hire Lexington or something.
Goshh, for those who do not remember my case, I forgot to add that the account is 6 times late for up to 120 days I just checked EX website and the outcome of the dispute is : UPDATED! Except the statement they didn't even verify it

At that time 2 of my reports were under reinvestigation for this account, but I don't see any inq from them on any of my reports. I missed one part from the letter I got from EX. They wrote that they are investigating it and will get back to me within 30 days. Report date is April 11th, 2002 but when I go to the website it says due on April 18th, 2002.

BTW, I just got a new tradeline posted on EQ (Bank of America credit card) and my score jumped to 657. But I know it doesn't matter how high the score is if I still have this ANBCC account as late there. The bad part it states: SECURED CREDIT CARD!! I was assured by EVERYBODY at BofA that it will not say that. Same my TU, it only reports my closed installment loan and this da** ANBCC/Citi account only. No AU on ATT Platinum, and no Citibank installment loan and no BofA credit card either! What a MESS!

Re: Can't get rid of ANB/Citi accou Have you asked them to send you a detailed accounting of the payments? The idea is to see if they can send you an accounting or if the history of the payments has been purged and therefore no record exists. I have used this technique several times on old accounts. You can try sending the letter that Citi can't verify your payment history to each of the CRA's and see if you can get a removal. My thought has always been, if the creditor can't provide you the information, they certainly can't provide it to the bureau. If this is over a year or two old that is likely the case. If your histories reported are truly different, sue Citi once you obtain the method of verification from each of the bureaus. Be prepared to show damages (i.e. can't get credit) etc.

I have not asked to for detailed payment info yet but I'll do that today If you think it is not too early. If that won't work, I should request method of verification and then write a letter to Citi asking to remove it or be sued right? Martig4, I appreciate that very much.

I just called them I they said they won't be able to send me statements or accounting info or anything because the account is CLOSED. If they could do it, it would be $2 each!!!! I called the 1-800-533-5600 CS number. What's next? I thank you guys so very much for all the help. That's the only thing I have left to be fixed and then ... just waiting to get my AMEX someday (of course If the ANBCC account would fall off)
Re: Can't get rid of ANB/Citi accou Its a good sign that they couldn't provide any information over the phone. On closed accounts many companies keep only the information reported to the credit bureau, but not detailed records to back up that information. I once had a 30 day late with Cap One. Once it was over a year old I called the customer service and asked for the details. They told me that only 12 months of detailed history is kept and offered to immediately remove the late notation since they couldn't possibly verify it. I would send a request to Citi CRRR requesting they verify your payment history. What you need are dates the installments were allegedly due and when they think your payments were recieved. If that information cannot be provided, I would say they can't legitimately validate your payment history. If the accounts do come back verified from Citi and they are unable to provide this information, then sue. The burden of proof is on them to validate information "verified" by the credit bureau. A lot of it has been easier than I ever would have imagined. However, regardless of whether I made a late payment or not, if someone is going to accuse me of something, then THE BURDEN OF PROOF SHOULD BE ON "THEM". . .NOT ME!! I am not the one who is reporting it. % THIS BUSINESS OF NOT BEING ABLE TO HOLD THESE CREDITORS, COLLECTION AGENCIES, AND CREDIT BUREAUS ACCOUNTABLE IS DRIVING ME UP THE WALL! We dispute, the CRA "verifies". What does that mean? I ask them. They tell me that they send a dispute form requesting verification to the source or they do it electronically? Either way, their rhetoric doesn't PROVE anything! So then we go to the creditor. They say that their records and what they are reporting is correct. I disagree with them. They say I did. . .I say I didn't! Big whup-dee-do! This is rediculous, guys. There's got to be a simpler solution for us, and I mean without having to keep every check and receipt we've written or received! There's just got to be one out there. For goodness sake, we have DNA, scientific evidence. . . and O.J. got aquitted. . . but we can't even get a "late pay" off of our "who are we but a bunch of nobody's" credit reports!! When you read the fcra definitions, a "consumer report" is NOT one that you receive, it's only one that's dissiminated to people other than you. The Cousin v TU appeal confirms this. Meaning: if you're the only one who sees your report and you push a lawsuit, you can't win because the report you got isn't defined as a "consumer report"... if it's not a consumer report then you can't sue for fcra damages... because fcra violations and damages occur off a "consumer report" as defined by the fcra. 2. When you sue, case law is proving that you must have actual damages... or the case gets thrown out. Almost always, the first question out of a lawyer's mouth is "What's your damages?" I would say the main exception to this rule would be a permissible purpose case. If your file is pulled by someone not permissible(as defined by FCRA 604) or authorized directly by you... then you might be able to prevail in a lawsuit without actual damages (as some of these pulls are soft and thus, don't affect score or your perceived credibility)... but someone now has accessed your information without a right and that in and of itself is punishable by money paid to the consumer, fines to the ftc, and possible jail time for the offender. We've covered this question of "why do I need actual damages" a lot, so I hope this clears it up
