Re: Can't get rid of ANB/Citi accou These questions are up to the trier of fact (the judge or jury). In small claims there is usually a low jurisdictional limit (eg, 5000 in california) so the question doesn't really arise. In a "real" lawsuit if you can show wilful noncompliance than similar awards are certainly conceivable...its all a matter of what one can convince a jury to award, ie how much they dislike the defendant.
Re: Can't get rid of ANB/Citi accou And there lies the key, whether the lawsuit is filed in small claims or in a higher court of law. Since the average consumer does not have the time nor the resources (for an attorney), they file in small claims, and the CRA's and CA's cannot really be "damaged" if the plantiff wins, because as you said, small claims have low jurisdictional limits, i.e it's $5k out here in Nevada just like in CA and an occasional $5k hit to a CRA is a drop in the bucket. BTW, I don't think there are many folks out there who if they were on the jury and a CA was the defandant, would like them (the CA) much. Especially if the plantiff is one of us who has a paper trail a mile long, and who knows the system and who can point out in plain English how much trouble the CA has put them through, and how the CA continually ignored the plantiffs' rights. I believe it's safe to say most everyone over the age of 18 has dealt with the CA in one way or another, and we all know what slime the CA's really are.
Re: Can't get rid of ANB/Citi accou Yes, but most folks are suing in Small Claims Court which has a ceiling on damages. Has anybody tried for a jury trial asking for millions? Dancer
Re: Can't get rid of ANB/Citi accou All right, I GOT THE LETTER!! To remind you all, I wrote goodwill adjustment letter and got the following reply: Dear XXXXX, We have received your request to change manner in which the above mentioned account is being submitted to the credit report agancies. Upon review of your account, we have determined that the current and past due account history is being reported accurately. I think I got them. PAT, have you figured out how to proceed in this case? Fortunetely, they report incorrect (different) information on all of the credit reports. Would anybody know what should I do next now? Thanks!!
Re: Can't get rid of ANB/Citi accou I suppose most folks would frown on the idea of letter-bombs? Dancer
