Cant get the CRA to remove invalid information.

    Hi all, great site!! I have learned a lot about fixing my credit just browsing around the site. I am a total newbie to credit repair and have made several, hopefully rectifiable mistakes. I had found this site by posting on Yahoo Answers and one of the posters pointed out this site.

    Anyhow hereâ??s my problem. I had filed for bankruptcy 3 years ago, and went to court in September of 2004. I had refinanced my house with an adjustable ARM in September 2005. This loan is due to reset this October. When I did the refinance I rolled the house loan with Wells Fargo and a second mortgage with Bank of America into the new loan with Wells Fargo. Other than the 6 months prior to the BK and since the BK I have had a perfect payment history and have paid off several new loans to help improve my credit as well as piggy backing on my momâ??s credit card.

    Unfortunately the credit agencies are all reporting the previous house loan and the second mortgage as included in the bankruptcy. I had the second mortgage for 5 years and had a perfect payment history on it. Both loans were paid off with the refinance. I have contacted all three credit agencies numerous times, sent them the bankruptcy paperwork which showed the house as being excluded from the bankruptcy as well as the new loan which shows both loans being paid off. They still refuse to update my credit report, they keep saying that this has dispute has already been investigated. Since these show up in my credit report as foreclosures/bankruptcy, I cannot refinance without paying a high interest rate.

    This really pisses me off since Wells Fargo was the bank I that had the original mortgage with plus the new mortgage, so they know darn well that both of the loans were paid off in the refinance yet they still would not refinance the loan, despite having a perfect payment history of 8 years with them, plus 100k in actual equity in my house.

    So anyhow after all that I was hoping some of you credit gurus could help me out of this mess before the loan resets to a higher interest rate. So here are my questions.

    Did I make a huge mistake by sending the CRAs the BK paperwork showing the house loans were not being included in the BK? I didnâ??t send them any of the BK paperwork showing other accounts, just the paperwork that showed that the house was being excluded from the BK as well as the new house loan paperwork showing the two existing loans as being paid.

    Does anyone have any ideas as to how long this should take to get these items removed from my credit report?

    Should I contact Wells Fargo and Bank of America to get them to stop reporting these as included in the BK? Would this do any good if I did?
    Any idea what department or who to get in contact with at these banks?

    Can I force Bank of America to report the satisfactory payment history of the second mortgage to help boost my credit score?

    First, welcome to my world! Invalid info on your credit report is how this site came about.

    Secondly, NEVER send the CRA a copy of your BK paperwork. You literally have no leg to stand on with future disputes (and you will want to make future disputes).

    I would start with Wells Fargo and try to see what they think they are reporting. It could just be a breakdown in communication between them and the CRA.
