Received letter from Westmoreland/Cap1 back in June about a CO past SOL, past 7 years. I sent them a validation letter, never heard back. Last month, I get a letter from Cap1 asking me to transfer the balance owed onto a Visa-- ummm, I'm not stupid. anyhoo, since I hadn't heard anything from them regarding validation, I just ignored this second letter. today... a new tradeline "Cap 1, ATTN: disputes" shows up on EQ as a C/O with the same acct number. I'm super-ticked and have already disputed with EQ. What's my next move, should I 1) just wait (impatiently) for EQ to investigate 2) send Cap1 a letter now, or only if they confirm the tradeline or 3) just sue them, they've already broken the law. Any help appreciated.
Contact Daniel Edleman at www.edcombs.com This is a Chicago consumer law firm that is suing Cap1 over this stuff. A CN'er started the ball rolling. http://consumers.creditnet.com/straighttalk/board/showthread.php?s=&threadid=42380
This unvalidated acct was cleared off EQ after dispute, but now it is back... this time on TU. I've filed complaints, so we will see... I figure its just a matter of time b/f it shows up on EXP. Anyone else having trouble with C1/Westmoreland?
letters out to FTC, BBB.... one day after receipt: DELETED. I think it is a very bad sign when a credit card company starts buying old debts. Is Cap1 doing that poorly?
