Capital One, BK papers and the CRAs

    Capital one is incorrectly reporting to Transunion that my old account is "120 days past due". This account was discharged in my 1999 Ch 7 Bankruptcy. I of course disputed with Transunion and it came back verified. I contacted Capital One and they stated they need my bankruptcy papers. I know you aren't supposed to send those to the CRA's but what about to an individual creditor. They stated when they received the discharge papers that it could be correctly reported as "Included in Bankruptcy" It is reported correctly on Experian and Equifax. Any ideas or suggestions are greatly appreciated!!

    From what I understand, send them a copy of your creditors matrix showing that they are listed and your docket number.

    Granted, some serious time has passed since you were discharged, but you could also contact your BK attorney and follow their advice. Depending on your BK contract with them, they may or may not charge you for "taking care of" the problem, whether they just tell you what to send them or by handling it themselves. I made sure that the fee that I paid to my attorney was definately comprehensive.

    Thanks, I sent them the copy of my discharge papers and the original schedule F from the filing. Hopefully they will correct it with that. I'm just hoping they don't forward my bankruptcy papers to the CRA's.

    San Diego:

    I did Bk Ch7 in 1/99. I just sent filing letter, sched. F, and discharge letter to all three CRAs (don't anybody shoot !). I did this because I want to finance an auto late this summer. Most of the BK included creditors were showing charge-off / write-off and nothing else, because they have no real interest in updating for bankruptcy.

    My goal was to have the report ACCURATE. Bear in mind, all these "derogatorized" accounts (had better) go away 1-2/04 for me. My action was prompted by my home refinancing loan officer asking me, "what about this Fleet CC Charge-Off" ?

    I realized I'm better off having all the BK included creditors accurately noted as "Inlcuded in BK/Never Late" AT THIS POINT IN TIME (6+ yrs out of BK7) than having to explain nothing but "charge off" or "profit/loss write-off". I believe having only the public record hanging for 3 years more is better than having incorrect charge-offs with incorrect dates lingering in our files.

    All of our post-BK credit is spotless except for the errors. Our 2 Bank United (Sched F, O.C.'s) line of credit accounts got acquired with Bank United by Washington Mutual (what a creepy outfit that is !) and Wa Mu spawned a total of 4 more accounts from the 2 Bank United accts and called 2 charge-offs and called 2 real estate accounts with redeemed foreclosure ! What a hoot ! I sent CRRR disputes to Wa Mu at 4 different addresses and asked them to get their act together (that was 8 CRRRs total for me and DW, about $40 !).

    Anyways, I digress. I don't know how late in 99 you did BK, whether it was Ch. 7, nor how soon you need credit and for what. So, hopefully, you got some value out of hearing where I'm at.

    Oh, BTW, on our cash out home refinance I got 6.25% (0 pts.) on 3/20/03 with some documentation requirements. All cash out goes to clear ALL credit card balances !

    On disputes so far, I got roughly (at 4 credit bureaus, not 3 since I recently found out about Innovis) 75% corrected to "Included in Bankruptcy/Never Late", about 20% outright deletes, and 5% I'm going to have to fight harder on. Hopefully, none of the deletes come back on OC updates where I have to start getting nasty with them. The goodwill tone is always so much easier for me to write in !

    Sorry I'm so long-winded. I guess I highjacked your thread !

    Anyways, I invite anybody with constructive criticism of my approach (not my values) to speak up !
