Hey everyone new to the site but find it very interesting. I hope it is helpful. I am trying to repair my credit and worked out a deal with Capital One in January to get me caught back up on my payments. I made my payments January and February according to the agreed amount and then in March returned to my original payment. They reported me late on both months and say there is nothing that they can do.
Are the required to prove that I didn't make my payments? They claim they can't see who the employee is that made this deal. Do they have the burden to prove it to me?
Thanks in advance and hopefully if anybody else is reading this they can take some of this advice and apply it as well.

If you didn't get your agreement in writing, then it will be difficult for you to prove anything was agreed upon. Let this serve as a reminder to everyone that you should never take any customer service rep's word relating to new payment plans...always get it in writing!

Even then, 90% of the time you'll probably end up dealing with some sort of billing error. But at least you'll have some documentation to back you up when you approach the credit issuer to fix it.
