I have an unpaid Capital One account. The date of last payment was 12/99. The date of last activity was 12/99. I have received a scorewatch alert stating that there has been activity on a dormant card. Capital One has changed the date of last activity to 7/2000. Isn't this re aging and adding several months more time to obsolete date. According to Transunion, this was suppose to fall off 11/06. What can I do? Dispute with CRAs, Capital One directly, or what. Any assistance would be greatly appreciated. Boy, I was looking forward to having my report clean by May and this will prolong things. Besides, if they re age now, then they can certainly do it again. Lastly, I do have a hard copy from experian and equifax dating before this change. I just have a computer print out for Transunion stating the initial fall off date. Help.

7/2000 might be the charge-off date, 6 months after the original delinquency date, which was 1 month after the last payment date of 12/99. Strange that it is only being reported now. Might indicate that Cap1 may try to collect before it falls off, or might make you an offer to transfer the balance to some new card, in effect resetting SOL.

Does TU still say this will fall off 11/06?

My True Credit Service for transunion doesn't show estimated remove date. I even called transunion and they say they can't see that info.

Before this apparent change, I had quietly questioned the 12/99 deletion date. I thought it should have been earlier, but I have no hard evidence. Now, I see how they have changed information on all 3 CRAs. I am real suspicious now. The amounts are slightly difference on each CRA. Of course the items are charge offs but they are still applying interest. Is this legal? The only thing I see consistent is an opening date of 11/99 for the 3 CRAs.

I am tripping off the fact that my EQ report list a last payment of 12/99 but my account isn't mark with the first 30 late until 06/00. I thought this is what the 7.5 years reporting was for. To provide creditors from sitting on past due debt thus extending the reporting duration. Isn't there a 90 or 180 days timeframe for them to report the date of first delinquency?

I don't know who to contact.
I am not against working out a settlement for the money owed, it would be a positive contribution to my overall utilization. But now this entry is going to linger on my account. And I have read how nearly no one negotiates for a deletion from Crap One.

Give me a next move if you can.

"My True Credit Service for transunion doesn't show estimated remove date. I even called transunion and they say they can't see that info. "

The data furnisher is REQUIRED to provide the original date of delinquency within 90 days of reporting the account, so that the CRA can remove old negative information after the 7 year period, which they are REQUIRED to do.
If there is no such information, Cap1 has not complied with FCRA, and TU cannot comply with FCRA.

Have you pulled paper, mailed, reports?

I am waiting for the paper reports to come. The problem probably will be that the report will be a production after the changed of date of last activity. Which I still find so ironic being that my report still states that the last payment was in 12/99. I guess they want me to believe that they let the first 7 months of delinquency slide. I am here picking my brain realizing that they re figured, re calculated re analyzed and re structured the situation.

    12/06 last payment
    so
    01/07 first delinquency
    ok
    added 7.5 years
    presto
    07/2007 removal date
they then added, subtracted, multiplied and divided, carried the 1. Tossed the 6. and decided
    last date of activity = 07/2007 - 7 years
    07/2000 date of last activity.
    Brilliant

I was too green to know that I needed paper reports when I got started and opted for the online free reports from all 3 CRAs. Have hard copies from equifax from before. Have an ADP furnished experian report from before. Waiting for an actual hard copy.

Question. Can you request from the CRAs a specific paper report if you have the specific report file number?

Midland Credit Mafia and Crap One have both got me with the re aging thing.
Pinnacle hasn't for now but they have blown up my original balance by more than double.

At this time, these are the 3 dragons I must slay.

    Thanks for all your input.

Are they merely math-challenged, or do they have a motivation beyond extending credit reporting? What is SOL for CC debt in your state?

I contacted Experian and my latest file states that Capital One will be deleted 03/07. Not as soon as Transunion first reported which was 12/06.
Received a surprise report from Transunion which states Cap One original removal date of 11/06. I received this hard copy from Trans a day after I called to question why they hadn't sent out my previous hard copy. The Trans rep is issuing me another one. Hope it is an updated one.

Ironic side bar. I also inquiried about a Midland and Pinnacle account with Experian. Experian has them being deleted 11/06 and 12/06. They were listed with Transunion as being removed 03/07 and 08/07.

3 CRAs with 3 different removal dates that are varying by several months. Would be nice if I come pick and choose which dates I am satisfied with.

I am going to step back and take a deep breathe or two. Maybe that EQ rep I previouly spoke to after receiving the alert is not as knowledgeable as she could have been. I am going to call back on monday during regular business hours and I will keep trying until I get a U.S. based rep. I will request a printed list of removal dates for my entries.

Fair and accurate reporting is a J-O-K-E.
