Capital One...what to do?

    I have a charge-off with Capital One from 1998 and everytime I dispute it with the CRAs, Capital One validates it within a few days or so. I wrote Capital One directly about two months asking for validation of this charge-off, the specifics of the account, yada yada...no answer...they acknowledged receipt of my letter but have done nothing else. Pretty typical, they validate my dispute, and yet when I ask for the validation, they don't respond. What is my recourse now? Advice? Thanks!

    I am in the same boat. I would do a PFB to them and offer to settle if they delete. They may counteroffer. I do know that Cap 1 works with Arrow Financial. These guys are real bad news, they will do everything short of bustin up yer kneecaps to collect.

    I was able to get Cap 1 deleted after 3 rounds of disputes by sending a procedural request. This worked for Equifax and TU.

    I have disputed cap 1 no less than 10 times on my DH's report and at least that many times on mine. I have gotten it off of my EX & TU, but not EXP. He has not had one deletion from them, and to make matters worse, it is is last negative on both reports.

    A procedural request worked? You sent a procedural request to the CRA, and they deleted the tradeline?

    Ours was included in a bk that was deleted. So now his report shows 1 account as "inc in bk" without the corresponding bk and not any other negative.

    You might ask what does the 1 unrated cap 1 do to his score? When it is under dispute, his FICO is 797. Take that "unrated" account out of dispute, and it drops 101 points to 696. I would say for sure that these "unrated" accounts have some bearing on your score, wouldn't you?

    Cap 1 plays hardball. Some have been successful suing them

    I have been disputing Cap1 chargeoffs (also from 98) Since October 02. Talked 2 times with Cooke
    after pfb letter,he stonewalled me. Re disputed all different angles with all 3 cra's, sent them a "daughter of nutcase" letter and Cooke sent "validation about 4 weeks later and an affidavit
    for me to sign that it wasn't mine. I signed it and sent it back along with an ITS letter on my lawyer's
    stationary. Last month they deleted my most recent
    charge off but I'm still witing for something to happen on my second one. At small victory against Cap1 to me is like a big feather in my cap :)
    I'm one of the lucky few that has been able to dget a cap1 deletion.
    My advise: Try everything in the book and then some. They are not invincible and they will cave in.

    I was just wondering what legal action I have. Is the 30-day waiting period that applies to CRAs also apply to creditors?, i.e. they don't respond and I can demand deletion. I mean, how can they validate so quickly when I dispute with the CRAs, but when I demand validation directly from them, they don't give it to me?
