Car payoff ???

    friend had disability and was unable to make car payments on a timely basis. fortunately, had credit life insurance and they have paid the balance on the account. However, unable to get clear title because finance co (ge capital) is saying late fees make them owe over 2k.

    shouldn't the late fees go away with the payment settlment. any suggestions for letters.

    I would think so, uniondiva,. if the late payments happened after the first date of medical disability (not necessarily when disability payments were first applied). I would call the EEOC and research the ADA (american disability act) to find out. It is my undestanding that if you're disabled (long term) and once your account is settled by disability payment - the account is settled and the company can't collect money from you anymore.

    At least, that's how it is with my mom. Every company became very hands off once she showed that she had long term disability and her insurance kicked in. Sallie Mae even forgave all of her student loans (!).


    I would get a good disabilities atty. Your friend may have good reason to go after the car company.
