car repo

    Today a friend who works with me car was to be picked up for repo due to her being 2 months behind..She said that her paymnets were due on the 25 of each month...Well after speaking to the company she went next door to the store and western union and sent one payment...Well about a couple of hours later the repo man showed up saying she owed 1173 she told me..Well she showed proof that the shwe went and paid for one month and the other month she had until june the 5th to pay because they give you a 10 day grace period...Well he said no that once it is in repo its all or nothing ..Is this true Well he could not get the car because her husband dropped her off ...But she said he would be back tommorrow to get it?Is there anything she can do???I told her I thought as long as she was caught up on on april payment she should be fine...be cause if what she says is true about the 10 grace period she should have til the 5th of june to pay again...Also if her payment are only 400 a month can they charge 373 to repo a car they never got?

    It is at the lenders discretion. Most will repo at 3 or more months late, some are sooner. If she was not all the way current the lender has the right to repo. She will now need to make all past due pmts + late fee's + repo fee's to redeem this vehicle. The clock is ticking if she wants it back. If this was the 2nd time it has been repo'd there is no guarantee she can get the car back.

    the car has never been repo and she was only late on april payment because from what I understand her payments are due on the 25th of each month so in theory mays is not due until the fifth of june counting the grace period...Also they did not take the car because it was not there..I talked to her last night and she says she will only have enough to pay her car note and not the repo fee..Can they still try to come back and take the car if all she owes is the repo fee.She said she will send it to them western union today...She is borrowing it from a family member...I told her to call the lender first to see about making some arrangements on the repofee..cause its possible they might still get the car..Can they??I told her I would try and find out but I really dont know..

    PPT3 is right. The car can be repossessed anytime the people who are carrying the loan want to do it. I bought a car with a 5 year contract, high interest because I was trying to re-establish my credit. My payments were due on the 5th of each month. I made payments on the car for 2 years without ever hearing from these people and then one day I got a call at work from them two weeks prior to the payment being due, asking when I would be making my next payment. Prior to this, my payments had never been late so I didn't understand what was going on but evidentally my car note had been sold to someone out of Chicago and I had bought the car in Arizona and they just assumed I was a bad risk, I guess. Anyway, I started a new job and because it was a construction site and they were so far behind, I started having to work 32-hour shifts and I missed sending out the next payment and thought surely one day won't matter and I had planned to overnight it to them. I had the payment on the front seat of the car, and the payment was only 1 day late, mind you and they came and repossessed the car, refused to give me back my personal items or the car. I even told them the check was sitting on the front seat of the car but they didn't care, they said it was too late for that. My opinion from this experience is that if they want the car that badly, they can pick it up at any time but it has ruined my credit from then on. Now that it's time for it to drop off, they sold it to Calvary Investments, who is now trying to collect it from me still. A friend told me this is illegal and to check out this website to find out what to do, so that's why I am here.

    so in other words she needs to pay them the car note plus the repo fee to be in the clear..She told me she sent the car payment of 400 western union today, but she did not have the other 373 in fees they added on...Do they charge you for evey time they come out..Also I thought as long as you gave them the money they would not take you car as i your case with the new job and the payment in the car..They can keep your personal property like that?

    I did a search on yahoo and found this..In louisiana self-help repossessions are illegal and if you protest they can not take your car..because it would be a brach of peace..so if i understand this right if she tells them not to take the car thye cant right? also they say that self help repossession is illegal except after the court order has be signed...So that means they cant take her car til they go to court???I am going to email her this info maybe it will help..
