Car Repo'd

    Remember, repo laws vary from state to state. In some states, they can come and just take your car--like a thief in the night! In others they can send someone and ask you for the keys and hope you turn it over willingly but really do have to take you to court. I had a car loan with Americredit--had a lot of money problems at the time and they were pretty easy to work with. Yes, they did call several times a day until I would call back--I never avoided their calls but they would call during the day while I was at work and because I'm in sales and in the field, there was not real work number they could call. But I have to say that they really did work with me.

    I don't know your situation or how you handled it, but the worse thing anyone could do is to AVOID your creditors! Call them right away when you know you are going to have problems--BEFORE they start calling you. They are much more willing to work with you and do what you say you are going to do when you say you're going to do it.

    If I needed to, I wouldn't have any hesitation about using Americredit again.

    In some situations, they'll sell it for market value; especially if it's a newer car in excellent condition.

    They have to sell it at a price that someone would consider reasonably close to it's value.

    Selling a $9000 car for $3000- not even close.

    The UCC states that if the lender does not auction the car in a reasonable manner, the car is then assumed to value the amount of whatever the deficiency is.
