CAs and Credit Reports

    What gives collection agencies the right to run a credit inquiry?

    My bf noticed that on his credit report, the CA ran a credit inquiry. The date they ran the inquiry happens to be the same date written on the first letter he received from them. When a CA acquires an account, do they inherit the right to check your credit report?

    Also, how is it possible that an OC won't deal with you (tells you to call the CA), the CA hasn't been willing to validate so far, and the delinquency is still progressing on the credit report as far as the OC is concerned. How is that fair and possible if my bf has tried calling to make a payment to the OC?

    Is there anything that can be done?

    What have you done in an attempt to get the CA to validate? When you say the delinquency is "progressing" what do you mean by that.

    The OC may no longer own the account, and they have every right to sub out their business.

    We sent a VOD letter with request to communicate in writing as opposed to those nasty phone calls. The CA replied with a letter asking us to call them. We sent a second VOD letter to which we are awaiting a reply.

    On the credit report the account is being reported by the CA as past due but every month it is advancing 30 days it seems.

    If the OC sold the account to the CA--then they shouldn't be able to update the CR monthly. I do not know if it was sold or assigned yet.
