CA's just never learn do they!!!!

    Hi all,

    Listen to this one.....


    Alliance One a CA has a collection on my credit report. I sent validation for this tradeline on a medical charge for 38.00 in april 2002.. Never heard anything...

    I get a letter in the mail from them on another medical charge for 120.38 from some medical Equipment that a hospital put into collection in may of this year.... I know this is mine so i call and say hey ill pay this 120.38 cause i know this is mine. They say okay what about the 38.00 for the other one and i say validate then we will see..
    I give them my CC number for acct 485298xxx for 120.38 only and again they say what about this 38.00 i again state this payment is for acct 485298xxx only...

    I get a receipt today and those bastards took my payment and applied it to the 38.00 then the remainder to the 120.38... I called the rep and she stated i can pay the funds as i see fit and hung up on me... What a willfull and blatant disregard to the FDCPA on multiple debts...

    Well my answer was to trot my little ass down to small claims and i filed today on them... They should receive thier summons by Friday....

    Do you think i should fax them a copy or wait and let them be surprised..

    By the way i sued them in my jurisdiction since this took place in my state and county? is this correct??

    Yes, you did it correctly. Also, you might consider calling your cc company and tell them they willfully and negligently applied payment to a wrong acct and they refuse to correct it so you want to dispute the charge. I don't know if it will work or not, but it's worth a try.

    Also, when the ca claims they had permission to apply the charge to the small acct, your proof it is b.s. is that they charge made to your cc is the exact amount of the acct. you agreed to pay.

    i also have the CC company looking into this aswell.. I think i have them on this cold.. Especially since they sent two receipts showing which accounts they applied funds to...

    I will only make this small claims go away with full deletion and 2,000. And all agreements before court i will get in writing.. none of this handshake and promise stuff..
