CA's turning up the heat

    I think my problems are too big for this board! Anyway, here it is. Got message from a PI saying he was doing an Asset/Liability and Financial Profile for his client Ccp Llc. He said he will be turning over pictures and reports to his client and the investigation is starting today. "Pictures"????? what pictures? Got another message from a CA wondering if I was going to do anything with my account and if not then I need to supply them with my Attorney info. Is this normal procedure for CA's?

    How much money is involved? Is this "PI" your first contact from the CA? If amount is small, and it is first contact, it sounds fishy, i.e. false or deceptive statements by "PI" to intimidate you into a quick payment. If you have his name, is he licensed in your state?

    They don't need to have your "attorney information" to sue you, nor do you need to provide them with it. It is your business whether you answer their suit directly, with contact from your attorney, or even (foolishly) by ignoring it and losing to a default judgement. This doesn't mean they will not sue, only they are trying to imply they will without actually saying they will. To say they will sue when they have no intention of doing so would run them afoul of FDCPA.

    OK, first, think a second. Just what assets is he looking at? What could he possibly have taken pictures of? "Oh yes, that's REALLY my wife".

    Lies, subterfuge, half truths, deception and veiled threats are the stock-in-trade of the Collection Agency. You know your financial affairs better than they do - is there anything they could possibly find that would be a problem? Probably not, but the sinister nature of the statement makes it sounf like the CA knows of hoarded millions you have that even YOU don't know about. And YES, you want a copy of the pictures, if fo nothing other than a laugh.

    This "PI" is probably the collector, or the collector at the next desk. He couldn't find his own a$$hole without a diagram, so don't lose any sleep about this "investigation".

    And if they DO fine secret millions you didn't know about remember - they are only entitled to their balance - the rest is yours, and you could probably write off their balance as a Finders Fee.

    As far as the CA who wants your attorney's name, I would just give him the name of the attorney with the biggest Bankruptcy Practice in town. Go ahead, call HIM. "Turn the heat up too much and he WILL be representing me."

    Yes this is my first contact, the PI is from La. and he only left his name not a company his client is from Ms. and the name of his company is Ccc Llp all this info was left on voice mail. I do not know who the OC is yet I have not contacted them or received a letter.

    Hi Jtek,

    Firts welcome to the board.


    More often than not, if a PI calls the consumer, it's usually a collector acting like a PI. Others had it covered, so I just spotted the thread so I could watch it. :)

    The thing that had me going was that he left it on your machine. I can't imagine the astonishing stupidity of such a move. To use a PI your debt would have to be large, the collection of which would make it worth paying a PI several hundred dollars to chase you around on a computer. It makes no sense to me for them to do that PRIOR to trying to collect the routine way. No, this is not normal practice.

    Do your homework Jtek. And don't lose that tape. I'm sure that what you'll find is a clear violation of FDCPA.

    Document EVERYTING.

    How much is this for? Is it possibly BUSINESS debt?

    Most of this debt is related to business, but what I,m learning is even though it is a C corp. and I am president I am personally responsible. Corporate Amex, Optima have already contacted me through GC Services and United Recovery respectively. The PI thing has thrown me for a loop. His area code is 504, Louisiana and he said his client Mr.xxxxxxx with Ccp is from the 601 area code. I did a reverse number look up and it comes up as Ccp Llc out of Picayune, Ms. I did a search in my state, Florida, and did not come up them. Maybe they are dba????
    Do you think I should call them and find out who they are collecting for or just wait it out(which will be tough to do)

    Well Jtek,

    What we deal with here is mostly "consumer" debt.

    It would not be out of the question for a business debt to be investigated by a PI. That's why I asked about it. Completely different animal.

    But I still believe they would first attempt to contact you directly, before spending money on a PI.

    FDCPA is not applicable. Most of us don't know much about business debt so you may want to contact a lawyer.

    Sorry we couldn't be of more help. Maybe someone else can help more, but I'm stumped.

    Butch I would agree on some of the debt but I believe Amex will tie me up on the consumer side of things. Have you seen an instance when a corporate card hit a credit report on the consumer side. thanks for your info to date, its appreciated.

    FCRA 603(C):Definitions:

    (c) The term "consumer" means an individual.

    FDCPA 803(3): Definitions:

    (3) The term "consumer" means any natural person obligated or allegedly obligated to pay any debt.

    It seems BOTH laws apply in this instance. It's not the nature of the debt, it's who they are going after taht seems to govern.
