I know that there is plenty of caselaw regarding the leaving of messages with 3rd parties whom the CAs call for 'obtaining location information', but I am trying to track them down after losing a bunch of the cases that I had stored and bookmarked on the computer... Thanks in advance. Time to rebuild my archives, again...
Thanks to EdCombs.com Chlanda v. Wymard, C-3-93-321, 1995 U.S. Dist. LEXIS 14394 (S.D.Ohio 1995). Committe v. Dennis Reimer Co., L.P.A., 150 F.R.D. 495 (D.Vt. 1993). West v. Nationwide Credit, Inc., 998 F. Supp. 642 (W.D. N.C. 1998) Shaver v. Trauner, 1998 U.S.Dist. LEXIS 19648 (C.D.Ill., Jul. 31, 1998) 1998 U.S. Dist. LEXIS 19647 (C.D.Ill., May 29, 1998) I'm still trying to get the actual decisions.
Looking for them ;-) I've run into a company which actually believes (even after the FTC bent them over their knees and gave them a $240,000 spanking for it - and a whole lot of other FDCPA violations) that still thinks that sending notes via third parties is a part of "obtaining location information"... ;-) The best part of the settlement, every employee has in their employment record a notice that they can individually be held liable for any violation of the FDCPA.
