Does anyone know much about this CA? Curious about your experiences. They just showed up on a Mobil charge off that was 6 years ago after I disputed with the CRAs.
I sent them a validation letter and on the 30th day I received a letter from them stating that they were going to close my account and delete all of their TLs. I just hope that it stays dead! A
millerm, I had the EXACT same thing happen to me, I disputed a mobil charge off from 6 years ago and bam they showed up. I sent a standard validation letter and today is day 30, if nothing shows up I have the estoppel letter all ready to go.
FicoSux: that's exactly what I am doing too. I sent a validation letter and then will do the estoppel and then send it all to the CRAs. Hopefully we'll get it all handled. I'm surprised they did this considering how old it is and the balance is $50....
FicoSux: P.S. Let me know how things go for you since our situation is almost identical. Feel free to send email - I have it on.
Ender, I sent it to: Cavalry Investments, LLC PO Box 27288 Tempe, AZ 85282 I just got my TU report back and there they are, re-aged and everything. My TU fako has dropped about 90 points because of them! A
Why send a letter of validation? You already have them NAILED for re-aging the account. What you ought to be sending is a DEMAND letter. Gib
Are you sure it's reaged?? You cannot tell the TU DOLA unless you call them and ask for it - you certainly cannot tell based on the report itself. With the other CRAs, at least they publish the DOLA but with TU you cannot tell. However, 108 point drop sounds like it. Cavalry sucks.
Well 33 days have passed and no response to my validation letter, they also reported to Experian today, got a nice 24 point drop for that..NO notation of dispute on all three reports so the estoppel goes out tomorrow. There had BETTER be something from them when I get back from vacation or I will be suing them...I am sick of this sh*t, it seems I take 2 steps forward and three back.
One more thing...This is from their web page under "compliance" Compliance Based on our extensive experience in acquiring and collecting delinquent receivables, we are confident that Cavalryâ??s recovery efforts will be consistent with your companyâ??s policies and procedures. We will apply tested recovery methods developed over a period of nearly ten years. These methods minimize conflict with debtors and stress voluntary resolutions on a â??win-winâ? basis. - We will provide our internal collection agents and third party agencies and attorneys with the resources necessary for comprehensive collection and litigation efforts. - We will comply with all governmental agency guidelines, Fair Credit Reporting Act and Fair Debt Collection Practices Act. - We will indemnify our client sellers to ensure that they are sheltered from any frivolous post-sale complaints. - We will provide quality post-sale support and service to quickly address and resolve any issue that may arise.
Sorry to hear that - they seem to really hang on. I was able to get it deleted from Experian but it is holding on to Equifax and TU. I even have a letter from MOBIL dated 09/1995 indicating that "because of your decision to file BK, use of your account is no longer authorized - please return your card in the postage paid envelope." QUESTION: if I have a letter from Mobil dated September 7, 1995 saying that further use of the card is unauthorized, could I not use that letter as proof to the CRAs as to how old this debt is and per FCRA, 7 years is the end of the line?? The grey area for me on this is the change in the FCRA in 12/97 to 180 days from first delinquency vs. date of charge off for starting the 7 year clock. It sure would be easier to use the letter from Mobil vs. going through validation, etc. etc.
