Cavalry trying to collect old cc debt

    Hello all,

    I got a call on my cell phone today from Cavalry. I didn't talk to them, though. Every now and then I get a letter from them offering to settle on a very old cc debt from 12 years ago. The OC was First North American National Bank, and I am not even sure they still exist. The debt was written off long ago and I have no intention of "settling". I'd like to know whether I should answer when they call or ignore it, let sleeping dogs lie and will it go away? They are not on my CR. CR is in excellent shape now and I have no intention of letting Cavalry ruin it. Any help is greatly appreciated...

    Send them a full cease and desist. The debt is time barred and unreportable.

    So they are just trying to make money off of me and hoping I will pay their settlement offer? I don't think so..I wonder how they got my cell phone number, though. Thanks for helping me, Apex.

    Yes, Jimmy . . . they are essentially hoping that you are ignorant enough to pay it. Most are unfortunately and therefore, the zombie debt industry can yield surprising profit.

    Unfortunatly cell phone numbers are no longer private. For the right price CAs buy provider listings.

    Sad isn't it . . . perhaps an invasion of privacy but, one would have to establish a reasonable expectation as to one in a phone conversation or number.

    OK so Cavalry keeps calling me. They call 3 or 4 times a day now from 2 different numbers. Will they eventually give up and quit or do I need to change my cell number to an unlisted one? If I talk to them on the phone or send them a C&D letter will that cause some kind of reset on the SOL and give them the right to start collections in earnest? I live in Florida if that matters.

    I read another post here about how CA's are trying to collect on old debts now. I have read here but am still kind of confused on the policies concerning the SOL and when it starts and stops. I know the debt is 12 years old and was written off long ago, and I am not even sure if the OC still exists.

    Any info is greatly appreciated..

    Thats spooky, they are calling that often on a 12 year old debt??? Wow!! I would fire off a C&D just like Apex said.

    Was this a high amount? Not trying to be nosy just wondering if they are still trying to chase old old debts because of a high amount?

    Another thing I wonder about is the fact your credit is good now & your income may be good also? Have you recently bought a car or gotton a house? That always brings the roaches out. Even the granddaddy ones. They are just hoping you'll pony up and pay them under the fear of thier wrath.

    BTW sending them a C&D will not reage the account or restart the SOL. Only paying on the account coulld start some issues. Send them the C&D & tell them to FOAD (fold over & die) while your at it.

    Do telemarketers quit? These people, the agencies, now have computers, they use them to dial numbers. They also have deals, even you can get this now, where you don't pay but a flat rate for long distance. This means they can keep calling you until they drive you crazy.

    I don't think you can make your cell phone more unlisted than it already was but they still got it.

    SOLs are state specific. This is true of the time and the rules. In some states, a debt that is SOL must be acknowledged as valid in writing by the person admiting to the debt. I don't know the rules for Florida. It would seem unfair if the rule is something ridiculous like you answer the phone to tell these people to stop calling you and that means you own them money. A law like that is crazy.

    You are going to have to learn about SOL in your state.
