I received a recent TU and EX report and a CA CBCS is reporting an installment loan with National City Bank of $100 for 1 month. Interestingly, they say it was included in a BK on 7/18/03. I have a discharged CH 7 on 2/00. Also, they list it as an open collection as of 7/03. First I have never had an account with the original creditor and the original creditor cannot verify. Second, am I wrong or would listing a loan included in BK as an open collection constitute violation of BK laws as it is an attempt to collect a debt in a BK. This account is not mine, but I want to threaten a lawsuit in Federal BK court.
