cc declined, BOA sends no letter

    I applied for a BofA Visa and it got declined and the stupid bank is not giving me a written letter stating why it was rejected. Because when the visa application got declined, the representative (a bozo) applied for a secured visa and now the system cannot generate the letter for me any more. When I call the bank they say, all I can do is file a complaint letter that will go negative against that representative. Now it is a gamble, if I apply again, I get yet another inquiry and another rejection.

    Because bank cannot send a letter, I cannot get the free credit reports that I am entitled to.

    I want to write a letter to the bank demanding that letter. I asked on the other board and Bill Bauer suggested to write a letter. IN HIS WORDS: "The letter should include a blank intent to sue form and 2 blank copies of waiver of service of summons in order that the bank might be more persuaded to believe that they may be sued in a court of law should they fail to send you that letter. "

    Has someone written such a letter? Can I see a sample of such letter? Any other suggestions?

    They HAVE to send a letter...BUT you DON'T have to have the letter to get a FREE CREDIT REPORT...

    How do I get the free credit reports. They say I have to write a letter with a copy of the decline letter from the bank. Do I just write to them stating that I was declined?

    What about going to www.transunion.com and following the directions for online CR? They ask you about being declined for credit, by whom and on what date. You then fill in all of your other info and then you may be able to access your rpt online for free.

    Also, are there any suggestions regarding the language for the letter demanding the rejection reason?

    I have NEVER had to PRODUCE a letter...

    I just call the 800 numbers...

    I have gotten FREE reports from all 3...

    They MAY or MAY NOT ask DENIED by WHO...

    It may have to do with living in COLORADO...(FREE CREDIT REPORT LAWS)

    So I guess my original question was in two parts:

    a) How to get the denial letter from the bank and
    b) How to get free reports without a letter

    Thanks for the answers for part b.

    I would still want to know why BoA denied because I might be applying for mortgage with them, and I would specifically want to first address the issues which they think are negative.

    Yes, I believe, it is the law, but when I call the bank they say their system cannot generate the letter because soon after the first application was turned down, the bozo representative applied for another application(secured card this time) and now the system only has the record for the latest activity and cannot get the rejection letter for the original application.

    I called the bank again and they say they cannot do anything. All I can do is file a complaint that will go against that representative as she used the system incorrectly. Or at least without full knowledge of the possible severe implications on the poor and the needy and the have-not's of the world...

    Okay, since I cannot find the right legal language, I am thinking of sending them a letter with simple 'layman' language something like this:

    "Send me the reason for denial or I will have no choice but refer to the appropriate law protecting me and take appropriate legal action against you. You can do either of the two things to avoid this from happening:
    a) Send me the reason for denial in written within 30 days or
    b) Erase your inquiry record from all 3 reports. "

    Something like that.

    Any suggestions folks?

    chargedoff,

    It's in the Fair Credit Opportunity Act, it's on the FTC site.

    They have to notify you of the reason in writing lest you scream they have discriminated against you by denying you credit.

    That's the only way they can cover their butts.

    BTW, have the employees at BOA forgotten how to use and pen and pencil or an old-fashioned typewriter -- shame on them!

    I am in process of drafting a letter for my needs here. I will post it here before sending it to the bank. I would appreciate everybody's feedback on that.

    Sassy, you are right about BoA'a staff. This super dumbo bozo blockhead rep kept putting me on hold, going back and asking someone else. I am pretty sure she was a trainee.

    I am absolutely apalled that instituation like BoA makes this kind of careless mistake.

    Has someone else gone throught this before?

    Sassy, Mandy, George, and all others who have read this thread:

    I am re-opening this thread as I finally got a written reason from Bank of America after a lot of insisting and faxing them my EQ to prove to them that they pulled a hard. I am confident they are making up the reasons. This is what they mention in their letter:

    1. Obligations are currently or formerly past due and/or public record filing
    2. Number of accounts historically paid as agreed
    3. Length of time since last reported delinquent rating

    I am pretty sure they made these up because they themselves told me that there is no way they can find the reason of decline for the original application. Because the manner in which they applied for a secured visa, the system deleted the original application. Here is why I say these are made up:

    1. too non-specific
    2. why is this a bad thing
    3. is it less or more? besides, this is kind of same as number 1

    I know they cooked it up. The problem is now legally they have sent a written reason. I want them to remove this inquiry.

    Any suggestions?
