Pulled DH credit report as we had just purchased new autos at dealershipa dn will be re-financing at my work credit union for a better interest rate. When i looked his report, he owed over 42, 000 in credit card debt. I immediatley questioned him (we are newlyweds). It seems as his ex-spouse has been opening up cards in his name and using them. She even got a card as late as last summer. We were planning our wedding, just to think at anytime she could have interfered financially! My DH has an appointment with an attorney, I have low trust in lawyers, I did put all the cards in dispute saying they belonged to ex-spouse and he has his divorce decree dividing th debts, I read it. he is not responsible for anything incurred after the divorce and these cards were opened after the final decree. Any advice to what to say to the lawyer?
That really sucks Annie. I would think that if the open dates are after the divorce decree date, then by highlighting the opening dates on the reports and sending a copy of the decree to show the date of decree, there shouldn't be too much trouble getting those removed. Of course, it usually never turns out to be as easy as it should. If she is using your husbands name to open these, then he needs to file a police report and put fraud alerts on his reports and prosecute her.
Thank you LKH. Remeber the good ole days when I could of just went up to her and kicked her a**! It just really frustrates me, as I know he will not want to prosecute her. I am going to demand that he as for the accounts off his report and request she bring verification to the lawyer's office.
Don't you need the permission of the other spouse to open a credit card in their name. My DH has two discovers in his name. Shouldn't that have raised some red flags?
I've got a friend that's going through this, and even though in the divorce decree it says her dh's ex has to pay it, legally the collection agency can try to collect against him. Per their lawyer. We are trying to get them to validate right now instead, which is turning out to be fun.
