Cease/Desist Update...

    Ok, I have checked (upon the advise of Paule - thanks) and find that you can only send C&D letters to collection agencies.
    Is there a similar letter to send to the original creditor? (I assume they can ignore the C&D letter, which they have). I really do not want this to go to collections.

    unfortunatley no

    the FDCPA specifically imposes liability on debt collectors, and intentionally and very clearly states that employees calling on behalf of the original creditor are not "debt collectors" pursuant to the act.

    the FDCPA does not impose liability on people in the collections dept. working for the original creditor, only on third party collection agencies.

    this is unconscionable that the law is this, but it won't change with a republican majority in both houses and a powerful banking lobby.
