Hello everyone,i need advice on what to do with a cell phone company. Thet are charging me over $1000 for calls made in sept. 2003 by a stolen phone they activated on my account without my knowledge or permission . The phone that was used was stolen from me in dec. 2002. When I called to deactivate the phone I told them I did not plan to active another phone any time soon. They said they would suspend the account for 30 days or until I activate another phone whichever came first but after 30 days they would still bill me my monthly fee even if I have a phone active or not. So I get my bill in oct.2003 for over a $1000 I call and tell them there mistake that there is no way I made those calls since I don't have a phone active on that account and tell me I still have to pay. Since then I've talked to about 5 people from there and they all tell me the same thing.They are telling me they reactivated the stolen phone on my account without my permisson or knowledge because i didn't call them and tell them not to, so it's my fault. I don't want to wait for this to go to collection or show up on my CR so my question is if there is any legal action I can take against them before either of those happen or any other advice would be appreciated.Thanks for the advice in advance.
You can't be held responsible for the STOLEN PHONE or $1,000 in charges...THE MOST THEY CAN GET YOU FOR IS $150-$300 EARLY CANCELLATION FEE...THAT'S ALL... DON'T QUOTE ME ON IT...I'm not an expert...that is just what my cellphone contract said...(MINE $300/PHONE)
File police report regarding stolen phone. Include that it was reported stolen to cell phone company. Send complaint to both state AG and to your public utilities commission. The cell phone company records will confirm the timeliness of your original report. They could have mitigated their own damages, as any reasonable person would, but were negligent.
