Chapter 13 and Tax Refunds

    Does the Chapter 13 trustee notify the IRS and tell them to not send you you're tax refund?

    I always got mine with no action taken by the trustee.

    I have a "little blue book" from the trustee that specifically says any tax refunds (besides amounts attributed to earned income credit, none of ours is) must be turned over. The trustee even wants vacation pay and any other money you receive over $500.

    When we were in Chapter 13 the IRS sent the tax refund straight to the trustee who in turn sent it to us. We filed in January of 98 and the tax refund was for the year 1999.

    I never involved the trustee in any of my IRS filings during the 5 years of my CH 13 and got my refunds each year with no issues.
