I have a buddy of mine that came to me today and ask a question I did not know the answer to, so I figured the pals at creditnet could help!

His question to me was this "I had a BK13 filed in 11/97 and on my Experian and Equifax it shows an open collection with last activity and status of 12/97. It then says this record will remain on record until 2/04. This collection was filed in my BK13 plan. I have tried disputing directly through the CRA but nothing happens. Should I:"

    1) Continue disputing it through the CRA's with proof

    or

    2) Dispute it directly with the CA stating that is was included in the BK13 and to update as a non-active collection.

Now if he disputes it with the CA will the date of last activity or status changes to 8/01 and thus be on record from 7 years from 8/01?

Any advice or knowledge would be well appreciated. Thank you.

Date of activity will remain the same. Date of status will update to 08/01. Should not report until 08, but FICO uses activity date for scoring model. Will lower his scores....
