We have done everything we could do, but we have hit rock bottom. We are filing Chapter 13 this week before we lose our house and our cars. There is a chance that a job transfer will save us, it will double our yearly income. If you file Chapter 13 and your circumstances improve, can you get out of it?
I filed a CH13 2.5 years ago. So I understand the process as well as anyone. Can you get out of it? I believe you can. Check with your attorney. Would it ever be wise to get out of it? I don't think so. Once it is filed, it is reported as such. All 3 CB's will undoubtedly pick it up as a public record. If you strike gold and find a way out of it, it will still be reported. All of your accounts will still be reporting as "inc in bk." So, yes, you could step in and pay everything 100%, but I don't see why you would. The damage would have already been done.
You can always decide to dismiss your case. In Ch. 13, you do not get your discharge until after your court approved payment plan is completed (normally 3 years). So, if your circumstances change you can dismiss your case, if you are prepared to pay everything you owe. I am not sure if the CBs will be able to pick it up as a public record if you never get it discharged -- If I had to guess I would say yes they would. I also want to remind you, if your circumstances change and you start making more money, you have an obligation yo report that to the trustee or they can dismiss your CH. 13 without your consent, if a creditor or trustee finds out.
