In 1999, I had to file for Chap. 7 BK because I lost my home to a fire because my insurance company paid very little to rebuild. They stated the FHA inspector failed to report defaults and held me liable. Anyway, I was young and still have to deal with this. What I need to know is can my former mortgage lender, ABN AMRO, include on my credit report both a Chap 7 BK and a Foreclosure? I surrendered the home to the lender, case was discharged, and then ABN AMRO initiated Foreclosure proceedings a year later after the BK. Please help. I'm having a hard time getting the credit agencies remove the Foreclosure, even though I showed them proof of the Chap. 7 BK! Is there some law I'm not aware of? Is it anywhere in FCRA that nothing can be reported on your credit report after a Chap. 7 BK? Please help. Thanks, Tom
I'm NOT an expert, but when I was in a similar situation this summer my attorney told me that if I lost my home to foreclosure and then declared BK 7, both would be shown on my report. But that doesn't sound right, so I hope you get a better answer. From your posts I'm assuming you've already disputed the foreclosure and it's coming back verified? Good luck! Poochie
Well in my case, I filed had to file for Chap. 7 BK BEFORE the lender started forclosure proceedings. My mortgage payments were current when I filed BK. When the BK court discharged my BK, then the lender initiated forclosure proceedings after I surrendered the home to them. I did dispute my credit report and the CRA is stating it's verified as a BK/Foreclosure. I just don't understand how the lender can report the foreclosure when the bankruptcy court discharged the debt and the home was surrended to them during the BK proceedings.
Tom I might be way off here but I got some similar advice off a earlier post. My situtation was my report showed a judgement from Ford and also the tradeline account as included in bankruptcy. I disputed it by saying I do not owe Ford for 2 accounts and that one must be deleted. I sent it in writing because it kept coming back as verfied. Well just today Experian and Transunion deleted the tradeline account. But for some reason the Equifax says paid as agreed.
