    Notice also that their license expired
    on June 30, 2003. It might be possible that they haven't renewed it in a timely manner and are therefore *technically* illegally trying collect!

    Whoohoo! Great catch Pd! I missed that!
    Ok, Elisa..with what PD has discovered, we'll move to the next step...which is the letter which I'll post in my NanaC's notions tonight and I'll give you a link. You see, if they are unlicensed or bonded, they cannot collect from you no matter what. They also can't report you to the CRA's and will have to remove that.

    And, if they do anything wrong in trying to collect, etc, then you can report them to the state for violating the state law and the state will go after them!! It's good stuff! I am working on some grad work but I promise to get it all to you soon!! :) Thanks for being patient with me getting this together for ya!

    Elisa: Hi! I thought about this all through dinner. I think the first thing we need to do is find out if this company renewed their license. Now, here's the thing..so, let's determine how to find this out for sure...I'll find that out and you can check on that tomorrow. Then, we can move on with real certainty as the best method, ok?

    Ok, elisa..here's what I'm gonna ask you to do..
    Please send out these emails right away..

    First, send licensing.commerce@state.mn.us an email and ask them if Financial Recovery Services is currently licensed. Be sure to give them the exact address as on your credit reports, ok?

    Second, email Nina Weston in TX (the email I gave you in an earlier post) and ask her if the CA in TX with the address on your credit report is bonded in TX.

    You can write those tonight and I know Ms. Weston will respond in the morning.

    As soon as you get answers, let me know here, ok?? That will be our first step!

    ohhh nana i feel so bad for all your hard work.....i just got a recent credit report this afternoon and the ca were different then the ones in tx and mn it looks like both accounts were sold to the same comp...in Va i'm so sorry i wasted your time....i'm still new FORGIVE ME it's only my second day i understand if you want to slap me go ahead
    before you never talk to me again....:( do you know of any good secure credit cards i could apply for .... that i possibly wouldn't be denied for right now i have 0 and with the charge offs and a tu score of 427 i would like to try and bump up my score jeez i'm so sorry i wasted your time i'm so fustrated

    Elisa, that's ok!!! Don't worry about it at all! Everytime I look stuff up, I learn new things and that's great!

    I can help with the CC, too...there's a thread here about credit cards after BK...even if you don't have a BK, the thread will help you because the cards are good for those building credit...

    thanks i'm checking those out right now....do you think it would be a good idea to email different banks or credit unions re secure cc and possibly attach a copy of my credit report before applying for a cc that way i wont get all of those additional hard inquires if i'm going to be denied anyway??

    I've done this and she responded to me stating she couldn't find a bond on file for the CA I was looking for :D This now means I can follow the steps in your "Notions" and have a "very good" chance at getting my collection item removed or they "must" remove it?

    My experience tells me it will be removed...they cannot undertake collection activity on you if they are not bonded to do so...:) The State of Texas would be after them if they did and they don't want that!

    Just curious though...if they are not bonded and that makes them illegal to collect, how do they continue to do it?? Is it just because people don't know they are illegal? Surely someone would call them out on this and they'd go and get bonded or stop collecting.

    I live in Texas and the CA is in Texas, so this one was really easy. I paid $10 and got the "certificate of no record" on its way!

    Dang it, dang it, dang it. I guess she overlooked them the 1st time around. I had sent the request for "no record" and she emailed me back just now stating there was a mixup and that there actually was a bond on file, only they had a slightly different address. The one I was looking for was in Mesquite and the one on file was in Dallas...pretty close, so I'm assuming they're the same. ARRGGGHHHH!!!!

    So I guess if I want my home loan in the next 30-45 days, I'm just gonna have to settle with them. :(

    And the way I read the statute for TX, and individual can sue for no bond! What leverage :)

    I do have 2 questions. My husband has an attorney attempting to collect a debt from years ago for a collection agency that is an absurd amount of money. If I am reading this correctly, http://www.lawdog.com/states/tx/st1c.htm it states that attorneys must be licensed as well? Is that how you read it? Or does the original collection agency have to get the bond?


    Second question. 6 years ago, I had a credit card that I owed less than $200 on that was charged off in 97. Yesterday, I received a letter from a collection agency is Chicago for over $1000 on that particular credit card, which I had completely forgotten about. I lost my job and honestly, that was the least of my worries. I have sent away to find out if they are bonded in Texas. My question is: What rules apply to a charged off account. Does that stay on my account for an additional 7 years? Or, will it fall off when the other does. I have made no contact with the CA. Thanks!
