Charge Off Date Issue - Unusual

    I have one last baddie on my reports (EQ, TU) and the situation is somewhat unique - I am not sure if I want to mess with this or not. Please give me your opinions.

    I had a car repo'd in 1997, actually hand delivered to the parking lot of the finance company. I know for a fact that I did not make any payments after June of 97 but the charge off date is reporting as 2000. Now, the dola is reporting as 2000 also and I know that is not accurate. My questions is, do I stir up trouble by asking for validation, only so I can prove that the dola is incorrect? If the dola can be changed to the correct date, it should be just about ready to fall off (within this year) versus having it on there for 3 more years.

    Is this a wise move? Any advice?

    Oops, I hate it when I leave out info!

    4 years here in Cali, and I believe 4 in FLA where this originally took place.

    This is what I would do...

    What month in 2000 are they currently reporting as the DoLA.

    If for instance it is June - 6/2000
    I would wait until 8/2004, then request validation from the CA (if its at a CA), and then dispute it with the CRAs as not mine. (Plus then it would also be obsolete under the FCRA, so if they update the CRAs with the correct DoLA, it would get deleted as obsolete anyhow.)

    What I would be afraid of is that they may have something that they may use to try to qualify as verification, and then quickly decide that this may be their chance to file against you. And without the concrete proof to dispute when the DoLA truely was, the judge may take their word for it and find that it was within the SOL.

    The date they are using is 10/2000, but I have copies of my credit report from 2001 with a 07/1997 date on it.

    I think I will try to push the issue, because it should be removed in July of this year, correct?

    If the OC/CA is reporting a charge off date past jan 1, 1998 then the account must be removed 7 years from the DOLA or 8/04.

    I would dispute as "incorrect DOLA, account is being illegally reaged by data furnisher"

    If they verify, send off a strongly worded ITS. You might want to go ahead and notify them that you know the account is also SOL.
