I had a department store credit card that was listed on my credit report in Jan 1994 as a charge off. It stayed on my report for 7 yrs. Now all of a sudden it showed back up again in July 2005 as - Unpaid balance reported as a loss by credit grantor - It is only on one report, experian. Is that legal? can I get them to remove it?
Send them a letter with return receipt, pointing out that they aren't allowed to report this debt after 7 years and demanding that they cease collection activity immediately, including any reporting to your credit report. Also point out statute of limitations. After you get the green card back, dispute the debt with all three credit bureaus. If it comes back that the collector verified the debt with any of the bureaus, they're in further violation for knowingly reporting something which is inaccurate.
Is this being reported by the OC, or by a CA? Once you have confirmed their receipt of your demand for removal, also dispute thru the CRA. Dispute as "obsolete - reported after 7 years, illegally re-aged". (You can check with the CRA what original date of delinquency they are reporting.) If it is reported and removed by the CA, they can keep reporting and removing all day long. If it is removed by the CRA thru an investigation, the CRA can block reinsertion. If the CA does not remove, you need their "verify" in response to your CRA dispute, to go after them.
