Chargeoff Making Payments

    I have a repossession on my credit report from 1997. The OC listed the "Date Opened" as 1997 and the "Balance Date" on Experian in 2002 and on TU 2003. The comments read "Charge Off - Making Payments" which is a complete lie. The balance amounts and the past due amounts are different for each CRA. What can I do about this???

    I would first dispute to the CRA's. If those come back "verified", then write a validation letter to the collection department. If they lie, then you could try a lawsuit. Just make sure you have some paperwork to back it up.

    I would write a letter to the CRA's showing that it has been over 7 years and must be removed, probably. Even though it does have erroneous information.

    Others may have other advice, too. :)

    Let's see.... the Charge Off is from 1997. Add 7 years to that brings us to 2004. There are less than 2 weeks left in 2004.

    If the TL is still on your file on Monday, January 3, 2005 I would file suit against the creditor for re-aging and against the CRA for not deleting adverse information over 7 years old.

    I bet that will get the TL removed PRONTO.
