This a little complex, so bare with me... I have been fighting this issue with Chase Bank for 2 months now. They keep telling me that they will look into removing this from my credit after the balance is paid off. I have been refusing to pay until they send me a letter stating that they will have this delinquincy removed from my credit. Any advice???? Do I need an atty??? Am I responsible for the balance since it was a mistake on there part??? I. 8/15/00 â?? A Check was issued for Augustâ??s payment. Stop payment was issued on 9/8/00 by Fundsxpress (Electronic bill payment service for my bank) because the check was not deposited in a timely manner. Chase deposited this check on 9/27/00 and did not acknowledge the stop payment. II. 9/08/00 â?? A new check issued for Augustâ??s payment. Cleared on 9/18/00 III.9/12/00 â?? Check was issued for Septemberâ??s payment. Cleared on 9/20/00 IV.10/17/00 â?? Car was traded in and the balance was paid in full by the dealership. Because the stop payment had not yet been processed the dealership was given the incorrect payoff. (Minus the amount of one monthly payment) V. 1/3/01 â?? Chase applied the stop payment check as a charge back to the account. This is 117 days after stop payment had been issued. VI. 08/2003 â?? Account matures and now shows as being delinquent. Note: Throughout the term of the loan every payment was made on time. The only reason that there is a leftover balance is because the stop payment was processed after the car was traded in and the payoff amount was given to the dealership was incorrect. There is not a payment missing for the term of the loan. The stop payment check was applied to the principle.
