Chase wants to help me?! Long

    My dh and I have been diligently fighting to clear our credit. There is an account that has appeared on his account and now recently on mine. This is not our account and we have no idea where it came from. We have copies of our credit records dating back to 1992 and this account only showed up within the last year.

    We disputed with the cra's and it remained. Then we received the following letter.

    Dear ____,

    As your credit card company, we value your business.(funny considering this is a so-called charge-off) It is important to us that we provide you with timely information regarding the dispute we received from the cra's. They have advised that you are contesting liability for the above-referenced account.

    We have informed the credit reporting agencies that the account should be reported as "disputed", pending further investigation. If you wish to continue to dispute the reporting of this account, we will be pleased to assist you. To do this, we ask that you send a signed copy of the enclosed Affidavit of Fact to the following address:

    When this information has been received, an investigator from our Fraud Department will contact you to further research your claim.

    If you no longer wish to dispute this account, please complete and sign the Affidavit of acceptance of Liability and return it to the following address.

    If we do not receive a response from you the account will continue to report as "Disputed by Consumer".

    Affidavit of fact - Fraudulent Credit Application

    This affidavit concerns credit card account number - xxxxxxxxxxx

    I, _______ have never applied for a credit card, nor have I relinquished any personal information about my residency, employment, or income, for the purpose of obtaining credit with Bank One, First USA Bank, or its affiliates including, but not limited to, Wachovia Bank and First Card.

    This Affidavit of Fact is true and correct to the best of my knowledge.

    Sinature, date, ssn, address, phone all required.

    Firstly, I cannot sign that because we have other accounts with those companies so I would be lying to say I NEVER applied with them.

    Secondly, I do not trust that they want to help us with this.

    I must respond somehow but I don't think the burden of proof lies with us. Can anyone suggest an appropriate response?

    What you might want to do is rewrite the affidavit so it reflects only the account you are disputing. BE CAREFUL with what information you supply, Banks and other credit card companies use these so called affidavits to trick you into providing them with the validation information they don't have. Also BE CAREFUL of any clause in their affidavit which states that you also give them and/or their investigator permission to contact you. Their so called employee/investigator is usually a debt collector, who will make no bones about pointing out the fact that you authorized their calls/contact.
