He knows he owes this, so its not like anybody's scamming him into paying something totally bogus. crowmom ============= Even so who does he owe it to? Without the Actual check that Question can't be answered. See jams post.
Re: Re: Re: check collection question Ok. Letter will go out today. Now, to deal with getting the collections removed - Pay the newspaper directly, and then what? Dispute the accounts as unknown to the CRAs? Demand validation, as in an original check, from the CAs? What's next?
Re: Re: Re: check collection question The letter sounds good to me. Down to earth, not throwing around a lot of legal jargon. When you get the check back, see if you can also get a letter from the newspaper that the account has been settled. By the way, I'd be settling for the $35 or whatever, not the $110. They may be able to legally charge a returned check fee, usually something like $35 or so on top of it, but I don't think they can charge interest. So maybe you'll pay $70 or so. I would dispute the CA accounts as "not mine" with the CRAs. Maybe they won't verify and it will be removed. If they verify, then send them a modified validation letter, something like you found it on your credit report and don't know what it is, you'd like them to validate for you. If they send you a copy of the check, send back a letter asking them to verify it with the original creditor. When they go to the paper, they'll find out it's not valid. If they say they verified with the original creditor, sue them immediately.
Re: Re: Re: Re: Re: Re: Re: Re: check collection question I suggest having a traveling notary or instructing them to forward a notarized copy of the check. ....You select the notary!
This whole returned check thing is a real fiasco at best. Add unethical players crooks, etc., it becomes a real potential to become a swindle. ><- <>- ><- <> Your only protection against this happening is to see the original check before paying.
Re: Re: Re: Re: Re: Re: check collection question *You don't! That's why you compare the original with the copy before you pay. I had a phone CO try to charge me $75 for 5 returned checks. When I demanded proof they sent me 5 bogus check copies. How do I know they were bogus-I still have the original blank checks.
Re: Re: Re: Re: check collection question If the newspaper accepts this payment, you'll probably get something from them stating that this debt has been paid and the matter is closed (or something like that.) This is your proof to the CRAs and CAs that the TLs should be deleted. Dispute to the CRAs as "not mine" and send a copy of the letter from the OC (newspaper) as proof. Then, send letters (along w the copy of the letter from the newspaper) to the CAs and politely tell them you dont owe them anything, and to please delete their entry from your reports immediately. The older ones will probably come of pretty easily, since they know they sold the account off to another CA. Now, if any of the CAs verify you can start getting a little firmer in your subsequent letters to them. This brings up a question I have about my sister...i'll start a new thread.
Re: Re: Re: Re: check collection question The bad check laws of some states allow the person hurt by an NSF check to recover triple damages up to a maximum amount (e.g., if the bad check is for $35.00, the injured party can recover $105.00 plua accrued interest at the state's statutory interest rate). Pennsylvania is one such state. That all being said, if the OP can get away with just paying the face amount of the original check, he'll be all the better off for it. Just my 2¢, John
I'm really not sure how I'm going to get them to give it up before they have the money, 1*considering if they give me the original, they definitely don't have any evidence anbro ><- <>- ><- <> ~~~ ><- <>- ><- <> ><- <>- ><- <> ~ ~ ~ ><- <>- ><- <> 1*While we're considering, consider this if they don't have any evidence they can't produce the original check.

The one with the check is who I offer to pay for deletion. Correct? anbro | ><- <>- ><- <> rite ><- <>- ><- <> ~~~ ><- <>- ><- <> ><- <>- ><- <> ~ ~ ~ ><- <>- ><- <> Why is it that our children can't read a Bible in school, but they can in prison? Think about it.
This is old, but still an issue. I wrote to the newspaper, and they never responded. I disputed as not mine with EQ, it dropped off. I disputed as not mine with EX, and they verified both of the entries. I'm kind of at a loss here. I guess I need to try to contact the paper again, but they don't seem to be interested in doing anything.
