Got a letter from the gas company today claiming there was a returned $40.00 check and demanding that I send them $40.00 There is no check # in the letter or any other evidence that there is in fact a returned check. Am I obligated to send them the $40.00 based solely on this letter?
If that is all the letter said, then they haven't proven anything. However, to be honest with, it sounds like you are playing games. If indeed you did bounce a check and they demand payment, you may find your gas shut off. I would make it good it you did it. Who knows, they may even report it, or turn it over to a ca who will report it. To me, it isn't worth all the trouble for $40. Now, if you did NOT bounce a check, then I'd tell them to kiss my ass.
That's what I want the gas Co. to prove to me before I give them forty smakers. A reasonable request is it not? I havent heard a peep out of the bank. No I didn't call the bank-If a check bounced it's their job to inform me of such a fact. If I never hear from them I can only assume there wasn't any check.
With or with out the $40.00 the bill is over paid .Thay can't shut the gas off on an overpaid bill can they? How do you collect 40 bucks on an overpaid bill?
If you are OVER-PAID with or with-out the $40.00, they can still collect for a bounced check. If you are over-paid, they CAN'T shut off the gas.
Did you bounce a check or not?? Why don't you just call your bank?? One phone call would take care of this.
YOU CANT BOUNCE A CHECK JUST BECAUSE YOU OVERPAID TO A COMPANY, YOU ASK FOR A REFUND OR CREDIT TOWARDS NEXT BILL!!!!!!!!
lb, I'm not trying to be sarcastic but read some of your old posts. You were the expert on helping me when I had a bounced check and when others had problems with checks as well. I think you will find your answers in your own posts.
Seriously if you didn't bounce a check then fine of course do't pay it. But instead of trying to see if they proved this or that, just call your bank for the love of god and see if you wrote a check that bounced, plain and simple. While you are sittting hear wondering what the letter is supposed to mean or prove, they could be reporting you to chex etc. Even if you overpaid, if you wrote a check for an amount and there wasn't enough to cover it, you bouned the check whether you overpaid or not. This is insane!!!!!!!!!!!!!!!!!!!!!!!
Good God your gas bill is only $40? We average $300 gas bills in the winter in OHIO! Call the bank and resolve this instead of guessing..If you don't call the bank it serves you right to get your gas cut-off!
Don't you balance your checkbook? If not, time to start. Most banks nowadays have a 24-hour automated system where you choose to see the last x # of checks cleared, x # of withdrawals, deposits, etc. And overpaid or not, the check shouldn't have bounced. Maybe the Gas company's accounting office is more efficient than your bank, so you heard from the former first. If it is overpaid as you claim, they would still be within their rights to pass along to you the penalty fee their bank charges for NSF.
